Alpharetta Deck Permits: What Actually Gets Checked

A permit isn't paperwork for its own sake — it's a checklist. Here's exactly what's on it.

HomeBlogPermit Guide

"Do I really need a permit for a deck?" comes up on nearly every first phone call. The short answer for almost any deck attached to a house, or any deck elevated more than a step or two, is yes — in both the City of Alpharetta and unincorporated Fulton County. The longer, more useful answer is what an inspector is actually looking for when they show up, because that list tells you what a well-built deck needs regardless of whether you ever get caught skipping it.

Setbacks From the Property Line

Before a single footing gets dug, the plan has to show the deck sitting outside the required setback from your side and rear property lines. Corner lots and properties backing up to easements or HOA-controlled common area add another layer of review. This is the single fastest way a design gets sent back for revision, so it's worth confirming your lot lines and any recorded easements before finalizing a layout.

Footing Depth

Footings have to bear below the frost line and be sized to the soil's load capacity — a real consideration on Alpharetta's dense red clay, which behaves differently than sandy or loamy soil when it comes to drainage and bearing strength. An inspector checks footing depth and diameter against the engineered plan before any concrete gets poured, which is why footing inspections happen before the framing goes up, not after.

Ledger Board Attachment and Flashing

If the deck attaches to the house, the ledger board connection is one of the most heavily scrutinized points on the entire inspection. Lag bolts or through-bolts have to be sized and spaced correctly, and — just as important — proper flashing has to direct water away from the house's rim joist and siding. A poorly flashed ledger is one of the most common causes of hidden rot behind an otherwise fine-looking deck, which is exactly the kind of damage we get called out to fix under our multi-level deck and repair work.

Guardrails and Baluster Spacing

Any deck surface more than 30 inches above grade requires a guardrail, and Georgia's residential code calls for a minimum height of 36 inches with baluster spacing tight enough that a 4-inch sphere can't pass through. Inspectors measure this directly, and it's a common fail point on DIY builds where spacing was eyeballed rather than measured.

Stair Rise and Run

Stair geometry gets its own line item: riser height and tread depth both have to stay within a tight, consistent range from step to step. Uneven risers are a genuine trip hazard, and it's one of the easiest things to get wrong when stairs are framed without a cut list planned in advance.

Engineered Plans for Elevated or Attached Decks

Once a deck is attached to the house or elevated beyond a certain height, a stamped engineered plan is typically required rather than a simple sketch. We prepare those drawings and file the permit application as part of every build, which is one of the steps in the process we cover fully in our deck build timeline post.

Why Skipping This Bites You Later

An unpermitted deck doesn't just risk a stop-work order mid-project — it can surface years later during a home sale, when a buyer's inspector or the title company flags it as unpermitted work. That can delay closing, trigger a demand for retroactive permitting, or knock money off an offer entirely. A permit pulled correctly the first time protects the investment, not just the inspection.
